1. Acceptance of Terms

By accessing or using Ask Pro Now ("the Service"), operated by Ask Pro Now LLC, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these terms, please do not use the Service.

Jurisdiction: These Terms apply to all users in the United States and Canada. Additional provisions may apply based on your location.

Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service. By using the Service, you represent that you meet this age requirement.

2. Service Description

Ask Pro Now connects users with experienced independent advisors who provide informational guidance and advice on various topics including electronics, telecommunications, home appliances, plumbing, and automotive issues. The Service facilitates consultations but does not guarantee specific outcomes or results.

Independent Advisors: Advisors on our platform are independent contractors, not employees of Ask Pro Now. They provide informational guidance based on their experience and knowledge.

Not Professional Services: Our Service does not provide licensed professional services. We are not affiliated with, endorsed by, or sponsored by any manufacturer, service provider, or government agency.

Platform Role: We act as a platform connecting users with advisors. We do not control, endorse, or guarantee the quality, accuracy, or legality of advice provided.

3. User Accounts

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription and Billing

Pricing

Current subscription pricing is $35 USD per month. All prices are in US Dollars. Canadian users will be charged the equivalent amount in CAD based on current exchange rates.

Recurring Charges

Subscriptions are billed monthly on a recurring basis and automatically renew until cancelled. By subscribing, you authorize us to charge your payment method on the recurring billing date each month. Your billing date is the date you initially subscribed.

Billing Information

Charges will appear on your statement as "Ask Pro Now" or "ASKPRONOW". You are responsible for maintaining current, accurate payment information. If payment fails, we may suspend your account until payment is received.

Free Trials

If we offer a free trial, you must cancel at least 24 hours before the trial ends to avoid being charged. If not cancelled, your paid subscription will automatically begin, and you'll be charged the subscription fee.

Cancellation

You may cancel your subscription at any time through:

Cancellations take effect at the end of the current billing period. You retain access until that date. No refunds for partial periods unless required by law or our Refund Policy.

Refunds

See our Refund Policy for complete refund terms. First-time subscribers may request a full refund within 7 days.

Price Changes

We reserve the right to change subscription prices with at least 30 days' advance notice. You'll be notified via email. Continued use after the price change takes effect constitutes acceptance. You may cancel before the change takes effect.

Taxes

Prices do not include applicable sales tax, GST, HST, PST, or other taxes. You are responsible for all applicable taxes based on your billing address. We will collect such taxes if required by law.

5. Expert Advice Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

The advice provided through the Service is informational only and does not constitute:

• Professional certification, licensing, or credentials
• Warranties, guarantees, or promises of specific results
• A substitute for licensed professional services where required by law

Your Responsibility: You are solely responsible for:

• Verifying all information received through the Service
• Determining whether licensed professional services are required
• Complying with all applicable laws, building codes, and safety regulations
• Any actions taken based on advice received
• Any consequences, damages, or injuries resulting from following advice

No Professional-Client Relationship: Use of this Service does not create a professional-client relationship, duty of care, or fiduciary relationship with advisors or Ask Pro Now.

Results May Vary: Outcomes depend on individual circumstances, equipment, skill level, and actions taken. Past results do not guarantee future outcomes.

Local Regulations: For work requiring permits, licenses, or inspections (plumbing, electrical, building, automotive safety), consult licensed professionals and obtain required permits. In Canada, specific trades may be regulated provincially.

6. User Conduct

You agree not to:

• Use the Service for illegal purposes
• Harass, abuse, or harm experts or other users
• Impersonate any person or entity
• Upload malicious code or viruses
• Attempt to gain unauthorized access to the Service
• Scrape or data mine the Service
• Use the Service to solicit business outside the platform

7. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is the property of Ask Pro Now or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ASK PRO NOW, ASK PRO NOW LLC, AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ADVISORS ("WE") SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, exemplary, punitive, or consequential damages
• Loss of profits, revenue, data, use, goodwill, or business opportunities
• Business interruption or loss of business
• Damages resulting from expert advice, recommendations, or user actions
• Property damage, personal injury, or death resulting from following advice
• Service interruptions, errors, omissions, or unavailability
• Unauthorized access, data breaches, or security incidents
• Third-party conduct, including advisor actions or advice
• Force majeure events beyond our reasonable control

Maximum Liability: Our total aggregate liability to you for all claims arising from your use of the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

Essential Purpose: These limitations apply even if a remedy fails its essential purpose.

Canadian Users: Some jurisdictions do not allow exclusion or limitation of liability for consequential or incidental damages. If this applies to you, some of the above limitations may not apply, and you may have additional rights under provincial consumer protection legislation.

Service "AS IS": The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy.

9. Indemnification

You agree to indemnify and hold Ask Pro Now, its affiliates, and personnel harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Dispute Resolution & Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at support@askpronow.com or (844) 527-7663 to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith for at least 30 days.

For USA Residents: Binding Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except:

• Claims in small claims court if they qualify
• Claims seeking injunctive relief for intellectual property infringement

Arbitration Terms:

• Arbitration will be conducted by a single arbitrator
• Location: Cook County, Illinois, or by phone/video conference
• Arbitrator's decision is binding and may be entered as a judgment in any court
• Each party bears their own costs unless awarded by arbitrator
• For claims under $10,000, we will reimburse your filing fee

Class Action Waiver: You waive your right to participate in class actions, class arbitrations, or representative proceedings. All disputes must be resolved individually.

Opt-Out Right: You may opt out of arbitration by emailing support@askpronow.com within 30 days of first using the Service, stating your name, address, and desire to opt out. Opting out does not affect other terms.

For Canadian Residents

Disputes will be resolved in accordance with the laws of the province in which you reside. You may bring claims in the small claims court or appropriate provincial court in your jurisdiction.

Quebec Residents: Quebec residents are not bound by arbitration clauses under Quebec consumer protection law and may bring claims before Quebec courts or dispute resolution bodies.

Alternative Dispute Resolution: Canadian residents may also contact the Better Business Bureau or relevant provincial consumer protection office for assistance.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately.

12. Governing Law and Jurisdiction

USA Residents: These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. Federal law applies where applicable.

Canadian Residents: These Terms are governed by the laws of the province or territory in which you reside and the applicable federal laws of Canada. You may bring legal proceedings in your province or territory of residence.

Consumer Protection Laws: Nothing in these Terms limits or excludes your rights under:

• USA: Federal Trade Commission Act, state consumer protection statutes, Magnuson-Moss Warranty Act
• Canada: Competition Act, Consumer Protection Acts (provincial), Quebec Consumer Protection Act

Where these Terms conflict with mandatory consumer protection laws, those laws shall prevail to the extent required.

Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
